The US Chamber of Commerce and affiliates appealed its challenge against the Biden administration’s drug price negotiation plan to the Sixth Circuit after a federal judge dismissed the lawsuit for issues on standing and improper venue.
The notice of appeal filed Friday to the US Court of Appeals for the Sixth Circuit comes after an Ohio federal judge on Aug. 8 dismissed the lawsuit filed by the US Chamber of Commerce and its affiliates for lack of associational standing to challenge the constitutionality of the Medicare Drug Price Negotiation Program.
