US Asks to Toss Transgender Care Rule Challenge in Mississippi

The US Health and Human Services Department is asking a federal court in Mississippi to dismiss a health care provider’s challenge to a new regulation that bars federally funded health programs and activities from discriminating against transgender people when paying for or providing medical treatment.

There is no reason to reach the merits of the lawsuit because a Texas federal court has already precluded the HHS from enforcing the Affordable Care Act’s anti-bias provision against plaintiff McComb Children’s Clinic Ltd., the agency said in a brief filed Monday.
