US Abortion Pill Rules Bump State’s Use Restrictions, Maker Says

A generic mifepristone maker asked a federal appeals court to revive a lawsuit challenging a West Virginia law that makes it virtually impossible for the company to sell the abortion drug in the state.

West Virginia’s restrictions on mifepristone unlawfully encroach on the US Food and Drug Administration’s heightened regulation of the drug, which is used to end pregnancies up to about 10 weeks’ gestation, GenBioPro Inc. told the US Court of Appeals for the Fourth Circuit in its opening brief Wednesday.
