UnitedHealth Attempt to Strike Class Claim ‘Premature’

UnitedHealth Group Inc.'s request to toss class action allegations that it violated health plan agreements was called “premature” and denied by a district court.

The order from the U.S. District Court for the Southern District of New York is the latest in a lawsuit accusing the insurance provider of adopting a uniform policy of refusing to pay “facility fees"—which allow a health-care organization to bill patients a service charge for patient use of hospital facilities and equipment—for surgeries performed in out-of-network doctor’s offices.
