Two New Mexico businesses suspended by the HHS from helping agents and brokers sign up consumers for individual marketplace health coverage sued the department Thursday, claiming the action was arbitrary and capricious and violated federal law.
In a complaint filed in US District Court for the District of Columbia, Benefitalign and TrueCoverage claim their suspensions earlier in August for “potential anomalous activity” violate the Administrative Procedure Act, which governs the federal rulemaking process, and the due process clause of the US Constitution.
