Trump’s HHS Withdraws Appeal in Nursing Home Staffing Rule Case

The Trump administration will no longer defend a Biden-era rule that required nursing homes to comply with minimum staffing requirements.

The US Court of Appeals for the Eighth Circuit on Friday approved the Trump administration’s motion to voluntarily dismiss its appeal of the Biden administration’s hotly contested mandatory minimum staffing rule.

The rule would have required Medicare- and Medicaid-certified facilities to have 3.48 “hours per resident day” of total nurse staffing.
