Georgia Medicaid’s categorical refusal to pay for transgender people’s gender confirming surgeries is discriminatory and unlawful, two transgender state residents say in a federal court lawsuit.

Delshone Thomas and Gwendolyn Cheney filed a proposed class action against the Georgia Department of Community Health and Commissioner Frank W. Berry in the U.S. District Court for the Northern District of Georgia. The suit challenges Georgia Medicaid’s “transsexual surgery” coverage exclusion.
