A federal judge in Alaska won’t pause a case alleging Title VII’s proscription against discrimination based on sex prohibits the state from discriminating against transgender employees simply because they are transgender, despite the U.S. Supreme Court’s consideration of “the exact question.”
Judge H. Russel Holland will proceed to decide the parties’ cross motions for summary judgment on Jessica Fletcher’s claim that the state’s refusal to pay for gender confirmation surgery through its employee health plan is discriminatory and violates federal law, he said in a brief order Oct. 30.
