Transgender Deputy Surgery Case Will Go to Full Eleventh Circuit

A Georgia county that denied health-plan coverage for a sheriff deputy’s gender-affirming surgery will get another chance at defeating the deputy’s claim of sex-based discrimination, after a federal appeals court granted rehearing.

The full slate of judges for the US Court of Appeals for the Eleventh Circuit will revisit the case, the court said in an order Thursday granting Houston County’s request for en banc review. A three-judge panel ruled against the county in May in a 2-1 split decision, in which the majority found the denial of coverage was discriminatory under Title VII of the 1964 Civil Rights Act. ...
