Transgender Alabama Youths Seek Full Court Look at Care Ban Case

An Eleventh Circuit decision that allowed Alabama’s ban on some gender-affirming treatments for transgender minors is contrary to US Supreme Court and circuit precedent and should be reconsidered by the full court, plaintiffs challenging the ban say.

Transgender minors, their parents, doctors, and two pastors filed a petition for en banc review Monday, saying a three-judge panel got it wrong Aug. 21 when it applied rational basis review to a law that distinguishes among people based on sex. The decision was a “dramatic” departure from prior cases, which have subjected such laws to a higher review standard, they said.
