Texas Hospital Cleared of Wiretap Liability Over Meta Pixel

A Houston hospital system defeated a federal wiretap class action after a court determined that its use of Meta Platforms’ Pixel for marketing wasn’t done with the intent of violating the Health Insurance Portability and Accountability Act.

Two advertising agencies told Houston Methodist Hospital that the Meta Pixel was safe to use, but a journalist from technology news outlet The Markup reached out to the hospital, saying the online tracker was potentially capturing sensitive health information in violation of HIPAA, according to the summary judgment order from the US District Court for the Southern District of Texas.
