A Central Texas health system defeated a lawsuit claiming that its refusal to care for an allegedly disabled patient suffering from Covid-19 amounted to negligence that caused his death.
The patient’s widow failed to produce an expert witness to testify that the standard of care required doctors to treat the patient the same as they would have treated any other Covid-19 patient and that their lack of care caused his death, the US District Court for the Western District of Texas said Wednesday. Judge Alan D. Albright granted summary judgment for the system and doctors.
