Texas Doctors Fight HHS Appeal of Anti-Bias Policy Notice Win

A Texas federal judge’s decision striking down a federal government LGBTQ anti-bias policy should be affirmed, the two doctors who initially sued said in a filing with the Fifth Circuit.

Susan Neese and James Hurly urged the US Court of Appeals for the Fifth Circuit to uphold a decision by District Judge Matthew Kacsmaryk that prohibits Health and Human Services Secretary Xavier Becerra from using Section 1557 of the Affordable Care Act to fight gender identity and sexual orientation discrimination in health-care programs.
