The Texas Medical Board has defeated a lawsuit by a doctor who claimed it unlawfully denied her application for a medical license.
Sonia Hernandez Caruso didn’t state a claim that the board violated her 14th Amendment due process rights by depriving her of a property interest in a license without notice, the US Court of Appeals for the Fifth Circuit said Thursday in an unpublished opinion. Practicing medicine in Texas is a privilege, not a right, and Caruso had no property interest in a license she hadn’t acquired, the court said.
