A Texas district attorney is requesting pretrial judgment in a suit that accused him of bringing criminal charges against a woman who self-induced an abortion despite a state law expressly exempting pregnant people from prosecution.
Starr County District Attorney Gocha Ramirez filed a motion for summary judgment with the US District Court for the Southern District of Texas on Tuesday, arguing that he’s absolutely immune from Lizelle Gonzalez’s suit. Alternatively, Ramirez said he has qualified immunity because he didn’t act to deprive Gonzalez of clearly established civil rights.
