Health-care liability plaintiffs in Tennessee must file new certificates of good faith whenever they add new defendants, new allegations, or new injuries to existing court complaints, a state appeals court said.
The original complaint against a medical doctor for failing to diagnose and treat a patient’s cancer was properly accompanied by certificate of good faith, but an amended complaint adding a wrongful death claim required a new expert certificate attesting to its merit, the Tennessee Court of Appeals said Wednesday.
