Target Pharmacy Beats Claim Over Filling Wrong Prescription

Target Corp. properly won summary judgment in a medical negligence suit alleging one of its pharmacies in Minnesota filled the wrong prescription because the patient didn’t prove the drug he took caused his anxieties and other health problems, a state appeals court said.

Phillip Musselman’s expert witnesses weren’t able to connect his anxiety, insomnia, paranoia, and other symptoms to his use of a 300-milligram dose of the antidepressant bupropion, instead of the 150-dose his doctor intended to be used first, the Minnesota Court of Appeals said in an unpublished opinion.
