The US Supreme Court declined to hear a case over the extent to which the federal drug enforcement agency can require a state official to hand over confidential prescription information.
The high court Monday denied a petition from New Hampshire’s prescription drug monitoring program over an investigative subpoena issued by the US Drug Enforcement Administration. The DEA sought data on Schedule II-IV controlled drug therapies prescribed to a specific individual.
The case would have given the justices an opportunity to weigh in on how DEA law enforcement efforts interact with state criminal laws.
