Supreme Court Passes on Walgreens Whistleblower’s Fraud Claims

The US Supreme Court announced Monday that it won’t review whether a whistleblower adequately alleged that Walgreen Co. violated the False Claims Act by improperly billing Medicare and Medicaid for medication.

The U.S. Court of Appeals for the Fifth Circuit ruled that pharmacist Bridgette Jacobs didn’t show that the alleged examples of fraudulent billing in her complaint amounted to anything more than innocent mistakes or negligence.

Jacobs asserted in her petition that the suit should be revived because her complaint satisfied federal pleading standards by alleging both specific instances of false statements Walgreens made, and a fraudulent course of conduct. ...
