Pennsylvania and New Jersey are asking a federal trial court to end a lawsuit challenging exceptions to Obamacare’s contraceptive mandate in their favor.
The exceptions adopted during President Donald Trump’s first term are arbitrary and capricious because they “sweep well beyond” the problem they were intended to address, reflect the defendant agencies’ failure to consider less burdensome means, and weren’t otherwise justified, the states said in a motion for summary judgment filed Tuesday in the US District Court for the Eastern District of Pennsylvania.
