Eleven states are urging an Ohio federal judge to reinstate the first Trump administration’s rule prohibiting taxpayer-funded programs from providing family planning and abortion services in the same place.
Led by Ohio, the states asked the US District Court for the Southern District of Ohio Jan. 24 to void the Biden administration’s 2021 rollback of Trump’s requirement that recipients of Title X federal family planning grants physically and financially separate abortion from other services.
The US Court of Appeals for the Sixth Circuit said in November 2023 that the Biden rule likely was invalid.
