Phoenix-based Banner Health will fight a scaled-down lawsuit over a data breach that affected roughly 4 million of its patients, health-care providers, insurance plan members and payment-card users, a federal judge ruled Dec. 20.
Judge Susan Bolton in the U.S. District Court for the District of Arizona upheld several claims in a class-action case arguing Banner Health didn’t do enough to protect sensitive information such as names, addresses, and medical histories from hackers. The ruling dismissed arguments that Banner breached a promise or contract to keep the information secure, saying there wasn’t proof such an agreement existed.
