Snap Diagnostics Can’t Get Medicare False Claims Suit Tossed

Snap Diagnostics failed to get a Medicare false claims action brought by a whistleblower tossed from a federal trial court.

Judge Charles Norgle of the U.S. District Court for the Northern District of Illinois June 5 declined to grant Snap’s motion to dismiss. The case was initially brought by a whistleblower who interacted with the Wheeling, Ill.-based company while exploring an opportunity to become a sales representative for Snap.

Now Snap, which supplies sleep tests to health-care providers, will have to face allegations it defrauded Medicare by orchestrating a scheme in which Medicare was charged for multiple nights of sleep ...
