A New York man who worked as a law enforcement officer near the World Trade Center on Sept. 11, 2001, can’t proceed with a medical malpractice claim against his doctor for failing to timely diagnose prostate cancer, a state appeals court said.
Michael Brennan waived his civil cause of action when he filed a claim through the September 11th Victim Compensation Fund established by the federal government in the wake of the terrorist attacks, the New York Supreme Court, Appellate Division, Second Department said Wednesday.
