SCAN Health Wins Lawsuit Against HHS Over Bonus Payments

A private Medicare Advantage plan prevailed in its federal lawsuit against the Department of Health and Human Services over the potential loss of $250 million in quality bonus payments next year.

SCAN Health Plan on Monday won its motion for summary judgment in the US District Court for the District of Columbia. The memorandum opinion written by Judge Carl Nichols held that the Centers for Medicare & Medicaid Services violated the Administrative Procedure Act in calculating the 2024 star rating for SCAN.
