Samsung Sues CVS Caremark, Tennessee for Drug Data Disclosure (2)

Samsung Electronics America Inc. accused CVS CaremarkPCS Health LLC in a lawsuit filed in federal court Wednesday of illegally disclosing private prescription drug data to the state of Tennessee.

Tennessee recently conducted an audit of Caremark’s 2024 claims, including in-network pharmacies, fees, amounts and timeliness of payments, and “spread pricing” practices—in which the pharmacy benefit manager charges more for a drug than it pays the pharmacy. Samsung alleged CVS agreed to provide Insurance Commissioner Carter Lawrence data related to its employee health plan—which Samsung argues is not subject to state law—as part of a consent order following the audit.
