Roe Ruling Provokes Biden Team Reminder on Emergency Care Law (1)

Doctors are legally required to stabilize pregnant patients experiencing a miscarriage or other medical emergency—even if a state law prohibits this treatment, an official from the Centers for Medicare & Medicaid Services said Monday.

Health-care providers have a “longstanding obligation under federal law” known as the Emergency Medical Treatment and Labor Act, which requires them to stabilize patients regardless of state laws that could conflict with treatment, Erin Richardson, chief of staff in the CMS Office of the Administrator, said at the American Health Law Association annual meeting.
