A proposed class of assisted living center residents received a setback in a lawsuit alleging the operator failed to live up to its contractual promises, as it didn’t show that common questions of law and fact took precedence over individual issues, a federal court in North Carolina said.
Individualized issues about their injuries outweighed common questions presented in a complaint filed by representatives of two late residents against Franklin Manor Assisted Living Center, the U.S. District Court for the Eastern District of North Carolina said.
