Relator Asks Supreme Court to Review Dismissal of FCA Case Against Takeda

A False Claims Act relator has petitioned the U.S. Supreme Court to revive a lawsuit against drugmaker Takeda Pharmaceuticals North America Inc. (United States ex rel. Nathan v. Takeda Pharm. N. Am.).

Relator Noah Nathan’s petition, filed in May, seeks a reversal of the U.S. Court of Appeals for the Fourth Circuit’s Jan. 11 decision dismissing the case, which alleged the company’s marketing of the drug Kapidex caused false claims to be presented to the government.
