Providers, Tennessee Weigh In on 48-Hour Abortion Delay Law

Tennessee’s 48-hour abortion delay law is one of the most extreme waiting periods in the U.S., imposes a substantial obstacle to abortion, and must be invalidated, abortion providers told the full Sixth Circuit.

But the law isn’t unduly burdensome and must be upheld, as information about how many women obtained abortions in Tennessee during the period before a lower court blocked it shows that it didn’t prevent a large fraction of them from having the procedure, the state told the U.S. Court of Appeals for the Sixth Circuit.
