Product, Warranty Claims Reinstated Against Alabama Hospital

An Alabama man can proceed with products liability and breach of warranty claims against a hospital where his wife died after receiving a contaminated infusion, the state’s top court said.

But he must still demonstrate that the provider breached the standard of care, it said.

Under Alabama law, claims for medical injuries against health-care providers aren’t limited to medical malpractice, and can include various theories of liability, the Alabama Supreme Court said Sept. 6.
