An Oklahoma pharmacy lost its suit against a pharmacy benefits manager that threatened to drop the pharmacy from its network, because related state laws don’t allow the pharmacy to sue, a federal trial court said.
The Pharmacy Audit Integrity Act and Patient’s Right to Pharmacy Choice Act don’t give Shattuck Pharmacy Management PC a private right of action, as the laws weren’t adopted for the “especial benefit” of pharmacies, the U.S. District Court for the Western District of Oklahoma said.
