Residents of two Vermont cities can ask for an order requiring Saint-Gobain Performance Plastics Corp. to monitor them for illnesses caused by their alleged exposure to a toxic chemical the company discharged into their drinking water supply, a federal court in Vermont said.
Vermont’s courts likely would allow the residents to pursue medical monitoring as a form of equitable relief, though they probably wouldn’t recognize it as a separate cause of action, the U.S. District Court for the District of Vermont said Dec. 27.
