Four plasma and blood products collection companies notched a partial win in a lawsuit brought by donors who reportedly tested positive for HIV or hepatitis C, as a federal court in Texas determined the donors couldn’t succeed on fraud and negligent reporting claims.
The donors alleged they donated plasma to one of four companies: Octapharma Plasma Inc., CSL Plasma Inc., ImmunoTek Bio Centers LLC, or BioLife Plasma Services LP.
The companies wrongly and negligently notified the donors they had tested positive for communicable diseases and been reported to the National Donor Deferral Registry, the complaint said.
