Planned Parenthood Clinic Defeats Property Use Restriction, for Now

An attempt to use real property law to ban abortions at a Planned Parenthood clinic in Florida has failed, as the state’s supreme court Feb. 23 lifted an order that had blocked the practice at a Kissimmee medical complex (Planned Parenthood of Greater Orlando, Inc. v. MMB Properties, Fla., No. SC15-1655, 2/23/17).

The Florida Supreme Court said a trial court that prohibited the Kissimmee Health Center from performing abortions lacked competent, substantial evidence that the facility would be violating a restrictive covenant in its deed if it offered abortion services.
