The leading trade group representing the pharmaceutical industry is taking Medicare to court to challenge the agency’s process for negotiating the prices of some of the drugs it spends the most on.
The Pharmaceutical Research and Manufacturers of America, or PhRMA, filed a complaint Wednesday in US District Court for the Western District of Texas, arguing the drug price negotiation program put in place by the Inflation Reduction Act is “unconstitutional,” and “a government mandate disguised as negotiation.” The trade group filed the lawsuit jointly with the National Infusion Center Association and the Global Colon Cancer Association.
