The justices of Wyoming’s top court appeared ready to uphold laws intended to eliminate most abortions in the state following oral arguments Wednesday.
The arguments centered on language added to the Wyoming Constitution in 2012 that protects a person’s right to make their own health-care decisions subject to reasonable and necessary state restrictions.
Plaintiffs’ attorney Peter Modlin told the court the decision to have an abortion is a health care one encompassed within the new constitutional section—at least as far as the pregnant person, not the fetus, is concerned. Modlin is with Gibson Dunn & Crutcher LLP.
