Pennsylvania Rule Setting Court for Medical Injury Cases Valid

A Pennsylvania woman failed in her bid to have declared invalid a state court rule that limits where medical malpractice plaintiffs may file their lawsuits because she didn’t argue that there was no rational basis for adopting it, a Pennsylvania court said.

Quiera Dockery didn’t explain how the provision—which mandates that health-care liability lawsuits must be brought only in the county where the cause of action arose—violates the state and federal constitution’s equal protection clauses, the Pennsylvania Superior Court said.
