Pennsylvania Medical Weed Industry Gets OK for Flavored Vapes

Pennsylvania’s health department can’t enforce an interpretive rule that prohibits medical marijuana growers from selling flavored vape cartridges, a state court said.

The health department’s “terpene recall mandate” was void, as it acted like a regulation but hadn’t been adopted through a formal rulemaking process, the Pennsylvania Commonwealth Court said Thursday. The court permanently blocked the mandate, which banned products that contain naturally occurring chemicals that give them their flavor, aroma, and color unless they’ve been “approved for inhalation” by federal regulators.
