Patient’s Post-Admission EMTALA Claims Barred on Second Look

A former hospital patient can’t proceed with a federal emergency care law failure-to-stabilize claim because she was admitted to the facility shortly after her arrival in an emergency medical condition, a federal appeals court said.

Ascension St. Vincent’s Clay County Hospital’s screening and stabilization obligations under the Emergency Medical Treatment and Labor Act ceased to apply once the patient was admitted, the US Court of Appeals for the Eleventh Circuit said in an unpublished decision Tuesday.
