Oxford Eating Disorder Coverage Suit Inches Toward Class Status

Eating disorder patients suing Oxford Health Insurance Inc. over its failure to cover certain nutrition counseling services moved one step closer to having their lawsuit certified as a class action.

Magistrate Judge Barbara Moses on Monday recommended certifying a class of patients covered by Oxford-administered health plans in New York who had their claims for outpatient nutrition counseling denied on the grounds it wasn’t a covered service. The patients also request a class covering people who didn’t submit claims, but Moses said it would be difficult to identify those people from Oxford’s records.
