Opioid-Using Prisoners Win Class Status in Suit Against Wexford

Inmates with opioid use disorders can proceed as a class in a suit alleging a prison health-care provider was deliberately indifferent to their serious medical needs.

Two classes of prisoners may seek injunctive relief and damages against Wexford Health Source Inc. in a suit alleging it violated their Eighth and 14th Amendment rights, the US District Court for the Southern District of West Virginia said Thursday.

The move is significant because Wexford contracts with state and local authorities to provide comprehensive health care services in about 100 correctional facilities across 11 states. About a third of its patients have OUDs. ...
