A foundation tasked with doling out more than a half a billion dollars Ohio is slated to receive from opioid litigation settlements is a public body under the state’s Public Records Act, the state Supreme Court ruled Thursday.
The OneOhio Recovery Foundation “is the functional equivalent of a public office” under the court’s precedent and must turn over documents when requested by a member of the public, the justices unanimously said. They rejected arguments from OneOhio that said it is a private nonprofit and that being an open body will harm its ability to do business.
