Oklahoma’s Birth Certificate Policy Invalid, Trans Advocates Say

Oklahoma must be barred from enforcing a policy that prohibits transgender individuals from amending their birth certificates to reflect their gender identity, trans advocates said in a federal appeals court brief.

The policy, which implemented Gov. Kevin Stitt’s (R) 2021 executive order, violates the equal protection rights of these individuals by discriminating against them based on their transgender status or sex, attorneys for plaintiffs Rowan Fowler, Allister Hall, and Carter Ray told the US Court of Appeals for the Tenth Circuit Tuesday.
