The full Tenth Circuit declined to review whether transgender advocates can move forward with a lawsuit challenging the constitutionality of Oklahoma’s ban on changing the sex marker on their birth certificates.
The US Court of Appeals for the Tenth Circuit on Monday denied the state’s request for en banc review of a June panel decision reversing a district court’s dismissal of the trans plaintiffs’ claims. The court didn’t provide a reason for the denial.
