An Ohio woman can’t revive a wrongful death suit against health-care providers whose conduct during her son’s birth allegedly led to his death more than four years later, as a state appeals court said she missed the deadline to bring her claim.
Ohio’s four-year medical statute of repose applied to the wrongful death suit, began running at the time the alleged negligence occurred, and couldn’t be tolled as to the mother of a deceased child, meaning her claim was untimely, the Ohio Court of Appeals, 12th District, said Monday.
