Ohio Court Ordered to Reassess Defunct Abortion Ban’s Measures

Provisions enacted with or amended by an Ohio law that banned abortion at six-weeks gestation are enforceable for now because reproductive rights groups didn’t challenge them in the original suit, an Ohio appeals court said.

The trial court properly enjoined enforcement of the six-week ban as invalid under a 2023 Ohio constitutional amendment protecting a right to abortion, the Ohio Court of Appeals, First District said Wednesday. But an order halting enforcement of other provisions that the plaintiffs never challenged couldn’t stand, Judge Candace C. Crouse said.
