Obamacare Anti-Bias Rule Row Should Proceed, Providers Say

A challenge to the Trump administration’s rewrite of a rule interpreting Obamacare’s anti-discrimination provision must go forward, as health-care providers and advocacy groups have standing to challenge its validity on behalf of their patients and members, they told a federal court.

Whitman-Walker Clinic Inc. and advocacy groups like Los Angeles LGBT Center oppose the U.S. Health and Human Services Department’s motion to dismiss their lawsuit seeking vacatur of the agency’s 2020 revision. The rule provides guidance about and clarifies the scope of the anti-bias provisions in Section 1557 of the Affordable Care Act.
