NY Abortion Protester Not Bound by 2005 Injunction, Court Says

A New York anti-abortion “sidewalk counselor” on Friday got a chance to prove that a 2005 court order limiting protests at Western New York clinics doesn’t apply to him.

Jim Havens, who was warned off of protesting in front of a Rochester, N.Y., Planned Parenthood clinic in 2017, wasn’t named in an injunction that created a 15-foot buffer zone around area clinics. He therefore wasn’t subject to it unless he was acting in concert with the people and organization named in the order, the US Court of Appeals for the Second Circuit said.
