Nursing Home’s Corporate Owners Must Testify in Malpractice Suit

Two of the individual owners of corporations managing a Kentucky nursing home must sit for depositions in a medical malpractice suit arising out of a resident’s January 2020 death.

Simcha Hyman and Naftali Zanziper’s pretrial testimony is required because they have knowledge of the facility’s operations, admissions processes, regulatory compliance, corporate structure, management agreements, and operational agreements, the US District Court for the Western District of Kentucky said.

This case illustrates the challenges posed to plaintiffs by nursing home ownership and operating structures, where the ultimate owners may not be involved in a facility’s daily operations.
